Some people think there is no remedy against a president who refuses to uphold his Oath Of Office as written in the Constitution, namely that “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States…” .
Do you know what are the duties of the Office of President of the United States? It’s not to hard to look it up: http://www.archives.gov/exhibits/charters/constitution_transcript.html
…he shall take Care that the Laws be faithfully executed…” Art. II, Sec. 3
Oh, lookie there, it doesn’t say some of the laws, or laws that are convenient to the President. Now, what other laws and provisions of the Constitution may this head government worker ignore with impunity?
There is a lot of chatter among scholars that there is no provision to force the Chief Executive to do his job. Apparently the Founding Fathers thought the threat of impeachment would be sufficient. As a Constitutional scholar, I can tell you that violating the Constitution is a “High Crime,” and deserves impeachment. Of course, given the politics of the country and the dedication of one of our national political parties to routinely commit high crimes, the current Senate would never convict this head government worker.
So what are the options left to us if the head government worker ignores the whole Constitution and tries to stay in office forever?
You know the answer, and you know that I cannot write the word here without incurring the wrath of the head government worker’s Dept of InJustice, the NSA, the IRS, the CIA, the New York Times, and the local school board. Bye-bye freedom.
Now the question: How can we freedom-loving entrepreneurs use this new rule of the game to produce more wealth for society? I’m at a loss to find the silver lining. Sometimes an abuse of power is nothing more than tyranny.
